GENERAL CONDITIONS FOR CONTRACTING DIRECT RESERVATIONS
EVA RECOMMENDS
1. ACCEPTANCE.- Making any reservation implies acceptance of these general conditions.
All inclusive: eThe reservation amount includes VAT, water, energy and telecommunications supplies.
Not included: additional services that the client may contract. Use of the apartment: When making a reservation on our website, the client and their companions agree to make appropriate use of the rented apartment.
Damages caused: the client will be responsible for any damages caused to the apartment, except for normal wear and tear caused by daily use. If the keys are lost, the client will be responsible for the costs of making copies and/or changing the lock.
2. USER.- The person making the reservation must be of legal age and is responsible for the veracity of the data entered.
3. PREPAID DIRECT RESERVATIONS.- To confirm the reservation made directly with Eva Recommends, it is necessary (unless otherwise agreed upon in advance which will be reflected in the OBSERVATIONS) to pay 50% of the total reservation once this confirmation email is received.
Proof of this 50% must be sent by email within 24 hours of receiving this document. If proof of payment of the 50% is not received within this period, the reservation will be cancelled. The remaining 50% must be paid 7 days after the date of receipt. before arrival to the accommodation and also send proof to: hola@evarecommends.com

5. DATA.- EIn compliance with article 5, section 1.a) of Organic Law 15/1999 on the Protection of Personal Data, we inform the client that the personal data provided to us will be incorporated into a file duly registered in the Registry established for this purpose by the Data Protection Agency, and will be used for the effective provision of the services contracted. Only those employees and suppliers who must know such data in order to provide said services will have access to them. In any case, the client may exercise the rights of access, opposition, rectification and cancellation provided for in the aforementioned Law.
6. OCCUPANTS.- The client can only accommodate the maximum number of people defined in the reservation made.
7. CLEANING.- The apartment will be made available to the client in proper cleaning conditions. The client agrees to leave the apartment in the same condition as when he/she received it and without leaving any rubbish in the accommodation.
8. MODIFICATIONS.- We reserve the right to change the apartment booked for one with similar or superior characteristics in cases of force majeure such as occupancy or damage occurring after the date of the reservation. These changes will not entail any cost for the client.
9. WARRANTY.- The client must pay a deposit in advance of entering the apartment as a guarantee for the amount specified in the reservation. This deposit will be fully returned, except in the case of damage to the apartment, furniture or equipment or situations of extreme dirt and waste, after departure (24/72h) once supervised by the Eva Recommends team.
10. CANCELLATION: For any modification or cancellation of the reservation, the User must contact the Owner at +34673503804.The cancellation penalty will be a percentage of the total reservation, taxes included, in accordance with the following rules detailed below (unless otherwise agreed with the client as detailed in OBSERVATIONS):
– High season:
* From 15 days to 7 days before arrival: 50 %.
* Less than 7 days, No Shows and early departures: 100 %.
– Low season:
* From 7 days to 2 days before arrival: 30 %.
* Less than 2 days: 75 %.
* No Shows and early departures: 100%
11. RIGHTS TO WITHDRAWAL
According to Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16, in its art. 103, the right of withdrawal will not be applicable to contracts that refer to (among others):
l) The provision of accommodation services for purposes other than housing, transportation of goods, vehicle rental, food or services related to recreational activities, if the contracts provide for a specific date or period of performance.
In relation to this section, with the User's request, the User gives his/her prior express consent, with the knowledge and acceptance on his/her part of the exceptions included herein, and consequently in these cases, he/she loses his/her right of withdrawal.
12. IDENTIFICATION DATA AND BANKING DATA
-Data transfers from the data controller: As required by law, data is transferred to the State Security Forces, and a guest record is sent to the tourist accommodation.
Eva Recommends informs users of the website that their personal data will not be transferred to third parties or organizations except when the transfer of data is covered by a legal obligation, or when the provision of the service implies the need for a contractual relationship with service providers responsible for processing.
In the latter case, the transfer of data to the third party will only be carried out when Eva Recommends has the express consent of the user and maintains a contractual relationship with the data processor that guarantees confidentiality and compliance.
Eva Recommends expressly prohibits the user of the website from sharing, providing or transferring third party data that may be obtained from contact, interaction or browsing or consultation through this website, unless the user can prove the express authorization of the user whose data they intend to transfer.
We remind website users that DATA also includes image files of people. Personal images are data protected by law, therefore, no one may use them without the express consent of the person who appears in them.
13- RESPONSIBILITY: Neither Eva Recommends nor the owner are responsible for any direct or indirect damage that may occur in the accommodation during the stay of the client and other people staying there. We do not accept any responsibility for material damage,
